Civil Marriage in Costa Rica

Civil Marriage for Nationals and Foreigners

Getting Legally Married in Costa Rica | Civil Marriage for Foreign Couples

Costa Rica is a beautiful destination for a wedding, but planning a celebration and completing a legally valid civil marriage are different matters. A civil marriage requires identity and legal-capacity review, proper documentation, notarial formalities, and declaration and registration with the Costa Rican Civil Registry.

AristaLegal assists international couples with the legal requirements before, during, and after the ceremony, allowing them to focus on their celebration while the notarial process is professionally coordinated.

Who Can Marry in Costa Rica?

Foreign couples and couples consisting of a Costa Rican citizen and a foreign national may marry in Costa Rica when they meet the applicable requirements and have no legal impediment to marriage. Same-sex civil marriage is recognized under Costa Rican law. Recognition or use of the marriage abroad depends on the law of the receiving country.

Documents and Legal Requirements We Review

  • Valid identification for each spouse-to-be.
  • Birth details, current marital status, and the personal information required for the marriage act.
  • Birth, civil-status, divorce, or prior-spouse death records when relevant.
  • Apostille, legalization, or translation of foreign records where required.
  • Identity information for two witnesses.
  • Legal capacity and absence of marriage impediments.

The exact document package depends on nationality, marital history, the issuing authority, and the applicable procedure. We review those factors before the couple travels.

Our Civil Marriage Process

  • Initial assessment of both parties and the planned date.
  • Review of documents, records, and pre-ceremony formalities.
  • Coordination of the notary, witnesses, and ceremony location.
  • Celebration of the legal act and execution of the marriage record.
  • Submission of the marriage declaration and follow-up with the Civil Registry.
  • Certified copies, apostille or legalization, translations, and international delivery when included in the engagement.

Ceremonies at Hotels, Beaches, and Private Properties

We can coordinate a notarial ceremony at our offices or another location selected by the couple, subject to legal and practical arrangements. Off-site ceremonies require advance scheduling and may involve additional travel-related fees.

After the Ceremony: Registration and International Use

The legal work does not end when the marriage document is signed. The marriage declaration must be handled through the applicable Civil Registry process. Once registered, official certificates can be obtained for use in Costa Rica and abroad.

When needed, AristaLegal can coordinate certification, apostille or legalization, and translation. An apostille authenticates specified elements of a public document; it does not by itself determine whether another country will recognize the marriage or its legal effects.

Frequently Asked Questions

Do we need to be Costa Rican residents to get married?

Costa Rican residency is not generally required solely to marry. Identity, capacity, and applicable documentary requirements must still be met.

Can we start before traveling?

Yes. Document review and much of the coordination can be completed remotely. We then plan the parties’ appearance and legal ceremony according to the applicable requirements.

What if one of us does not speak Spanish?

Both parties must understand the legal act. When needed, we coordinate appropriate interpretation or translation support consistent with notarial formalities.

How long does Civil Registry registration take?

Processing depends on the applicable procedure and the Civil Registry’s review. The deadline to report a marriage is not the same as a guaranteed registration time.

Must we remain in Costa Rica after the ceremony?

In many cases, post-ceremony formalities can be handled without an extended stay, depending on the documents and services requested.

Can we sign a prenuptial agreement?

Yes. We can advise on appropriate matrimonial property agreements, including arrangements involving assets or interests located in Costa Rica or abroad.

Can AristaLegal obtain an apostilled certificate and arrange delivery?

Yes. Once the relevant certificate is available, we can coordinate the required documentation and delivery arrangements.

Plan your Costa Rica civil marriage with legal guidance. Share each person’s nationality, current marital status, preferred location, and wedding date so we can outline the required steps before the ceremony.

Requirements, timelines, and recognition abroad must be confirmed for each couple and receiving jurisdiction.
